Welkom bij Numara. Deze Algemene Voorwaarden zijn van toepassing op ieder bezoek aan en iedere bestelling via www.numara.nl. Lees ze goed door voordat je een bestelling plaatst. Je kunt deze voorwaarden op elk moment opslaan of printen.

1. Toepasselijkheid

Deze voorwaarden gelden voor ieder aanbod van en iedere overeenkomst tussen Koud kouder koudst B.V., handelend onder de naam Numara ("wij", "ons"), en jou als consument. Door een bestelling te plaatsen, bevestig je dat je deze voorwaarden hebt gelezen en accepteert.

2. Producten & prijzen

Wij omschrijven onze producten zo nauwkeurig mogelijk. Afbeeldingen zijn ter illustratie; kleine afwijkingen in kleur of uiterlijk zijn mogelijk. Kennelijke vergissingen of fouten in het aanbod (zoals een duidelijk onjuiste prijs) binden ons niet.

Alle prijzen zijn in euro's en inclusief btw. Verzendkosten en eventuele andere kosten worden duidelijk vermeld voordat je je bestelling plaatst.

Wij kunnen prijzen op elk moment wijzigen, maar een prijswijziging heeft nooit invloed op bestellingen die al zijn bevestigd. Bij een aangekondigde prijsverlaging vermelden wij ook de laagste prijs die wij in de 30 dagen vóór die verlaging voor het product hanteerden.

3. Bestellen & totstandkoming van de overeenkomst

De overeenkomst komt tot stand zodra je je bestelling hebt afgerond en wij de ontvangst per e-mail hebben bevestigd. Controleer de bevestiging goed en neem contact op als er iets niet klopt.

Wij kunnen een bestelling om een gegronde reden weigeren of annuleren, bijvoorbeeld als een product niet op voorraad is of bij een vermoeden van fraude. In dat geval laten wij je dit weten en betalen wij een eventueel al betaald bedrag direct terug.

4. Betaling

Je kunt betalen met de betaalmethoden die in de checkout worden getoond. Betalingen worden verwerkt door gecertificeerde externe betaalproviders. Wij slaan je volledige kaartgegevens niet op.

Als een betaling niet kan worden geverifieerd of voltooid, kunnen wij de bestelling annuleren. Een eventueel al betaald bedrag wordt teruggestort.

5. Levering

Levertijden, verzendkosten en bestemmingen vind je in ons Verzendbeleid op deze website. Wij leveren uiterlijk 30 dagen na je bestelling, tenzij we iets anders met je hebben afgesproken. Het risico van verlies of beschadiging van het product ligt bij ons totdat het product aan jou is geleverd.

6. Herroepingsrecht

Je hebt het recht om je aankoop binnen 14 dagen na ontvangst van het product zonder opgave van redenen te herroepen. Hoe dit werkt en het modelformulier voor herroeping vind je in ons Retour- & Terugbetalingsbeleid op deze website.

7. Wettelijke garantie & klachten

Onze producten moeten voldoen aan wat je er redelijkerwijs van mag verwachten (conformiteit). Je hebt altijd recht op de wettelijke garantie. Is een product defect of niet zoals afgesproken, dan heb je recht op kosteloos herstel of vervanging, en in bepaalde gevallen op prijsvermindering of terugbetaling. Een eventuele extra (commerciële) garantie die wij bieden, komt bovenop je wettelijke rechten en beperkt deze nooit.

Meld gebreken of klachten via info@numara.nl met een duidelijke omschrijving, bij voorkeur binnen 2 maanden nadat je het gebrek hebt ontdekt. Wij reageren binnen 14 dagen inhoudelijk op je klacht.

Komen wij er samen niet uit, dan kun je het geschil voorleggen aan de bevoegde rechter.

8. Intellectueel eigendom

Alle inhoud op www.numara.nl, waaronder logo's, afbeeldingen, ontwerpen en teksten, is eigendom van Koud kouder koudst B.V. of haar licentiegevers en mag niet zonder onze voorafgaande schriftelijke toestemming worden gekopieerd, verveelvoudigd of verspreid.

9. Aansprakelijkheid

Wij zijn niet aansprakelijk voor schade die ontstaat doordat een product in strijd met de gebruiksaanwijzing of het beoogde gebruik is gebruikt. Niets in deze voorwaarden beperkt of sluit onze aansprakelijkheid uit waar de wet dat niet toestaat, waaronder aansprakelijkheid voor schade door opzet of grove nalatigheid, en niets in deze voorwaarden doet afbreuk aan je wettelijke rechten als consument.

10. Privacy

Wij verwerken je persoonsgegevens volgens onze Privacyverklaring op deze website.

11. Wijzigingen

Wij kunnen deze voorwaarden van tijd tot tijd aanpassen. Op je bestelling is de versie van toepassing die gold op het moment van bestellen.

12. Toepasselijk recht & geschillen

Op deze voorwaarden is Nederlands recht van toepassing. Woon je in een ander EU-land, dan behoud je daarnaast de bescherming van de dwingende consumentenregels van je woonland. Geschillen worden voorgelegd aan de bevoegde rechter in Nederland; als consument kun je een geschil ook voorleggen aan de rechter van je woonplaats.

Welcome to Numara. These Terms & Conditions apply to every visit to and every order placed via www.numara.nl. Please read them carefully before placing an order. You can save or print these Terms at any time.

1. Applicability

These Terms apply to every offer by and every contract between Koud kouder koudst B.V., trading as Numara ("we", "us"), and you as a consumer. By placing an order, you confirm that you have read and accepted these Terms.

2. Products & pricing

We describe our products as accurately as possible. Images are illustrative; minor differences in colour or appearance may occur. Obvious mistakes or errors in the offer (such as a clearly incorrect price) do not bind us.

All prices are in euros and include VAT. Shipping costs and any other costs are shown clearly before you place your order.

We may change prices at any time, but price changes never affect orders that have already been confirmed. When we announce a price reduction, we also state the lowest price we charged for that product in the 30 days before the reduction.

3. Ordering & contract formation

The contract is formed when you complete your order and we confirm receipt by email. Please check the confirmation carefully and contact us if anything is incorrect.

We may refuse or cancel an order for a justified reason, for example if a product is out of stock or if we suspect fraud. In that case, we will inform you and refund any amount already paid without delay.

4. Payment

You can pay with the payment methods shown at checkout. Payments are processed by certified external payment providers. We do not store your full card details.

If a payment cannot be verified or completed, we may cancel the order. Any amount already paid will be refunded.

5. Delivery

Delivery times, shipping costs and destinations are set out in our Shipping Policy on this website. We deliver no later than 30 days after your order, unless we agreed otherwise with you. The risk of loss of or damage to the product remains with us until the product has been delivered to you.

6. Right of withdrawal

You have the right to withdraw from your purchase within 14 days of receiving the product, without giving any reason. How this works and the model withdrawal form are set out in our Refund & Return Policy on this website.

7. Legal guarantee & complaints

Our products must meet what you may reasonably expect of them (conformity). You are always entitled to the statutory guarantee. If a product is defective or not as agreed, you are entitled to repair or replacement free of charge, and in certain cases to a price reduction or refund. Any additional (commercial) guarantee we offer comes on top of your statutory rights and never limits them.

Please report defects or complaints to info@numara.nl with a clear description, preferably within 2 months of discovering the defect. We will respond substantively to your complaint within 14 days.

If we cannot resolve your complaint together, you can submit the dispute to the competent court.

8. Intellectual property

All content on www.numara.nl, including logos, images, designs and texts, is the property of Koud kouder koudst B.V. or its licensors and may not be copied, reproduced or distributed without our prior written consent.

9. Liability

We are not liable for damage caused by using a product contrary to its instructions or intended use. Nothing in these Terms limits or excludes our liability where the law does not allow this, including liability for damage caused by intent or gross negligence, and nothing in these Terms affects your statutory rights as a consumer.

10. Privacy

We process your personal data in accordance with our Privacy Policy on this website.

11. Changes to these Terms

We may update these Terms from time to time. The version that applied at the time of your order applies to that order.

12. Governing law & disputes

These Terms are governed by Dutch law. If you live in another EU country, you also keep the protection of the mandatory consumer rules of your country of residence. Disputes will be submitted to the competent court in the Netherlands; as a consumer, you may also bring a dispute before the court of your place of residence.
